1 Subject and parties

These Terms of Service govern access to and use of the Attendae platform, available at attendae.com and attendae.app.

1.1 Service operator

The Attendae service is operated by:

1.2 Service definition

Attendae is a software-as-a-service (SaaS) platform for attendance management using dynamic rotating QR codes, geolocation, and verifiable participation certificates, designed for educational institutions, training centers, and event organizers.

1.3 Acceptance

Accessing or using the Platform constitutes full and unconditional acceptance of these Terms of Service, as well as the Privacy Policy, Acceptable Use Policy, Refund Policy, Security Policy, and SLA, all of which form an integral part of this document.

If you do not accept these terms, you must refrain from using the Platform. By creating an account on behalf of an Institution, the person registering declares they have sufficient authority to bind the Institution to these terms.

2 Service description

Attendae is a technology platform for managing attendance at in-person or hybrid educational events and training sessions. Core features include:

  • Creating and managing educational events with multiple sessions.
  • Registering attendees and participants with institutional identification.
  • QR-based check-in using dynamic rotating tokens, refreshed every 30 seconds to prevent fraud.
  • Physical presence verification via geolocation (when enabled with participant consent).
  • Three check-in modes: participant personal token, self-registration with event code, and admin scanner.
  • Attendance reports exportable in XLSX and PDF formats.
  • Verifiable participation certificates with a unique QR code per certificate.
  • Public certificate verification portal accessible by anyone.

2.1 Commercial model

Attendae does not operate on fixed plans by event size or on monthly subscriptions. The service is activated through a one-time service fee per event and, at closing, a variable charge based on the certificates actually issued — the full model, its components, and billing terms are described in Section 5 (Plans and payments) of this document. Current pricing — including discounted pilot pricing for the first cohort of institutions — is always published at attendae.com/pricing and may be modified with prior notice. A per-event license unlocks features for that specific event only and does not extend to other events on the same account.

3 Registration and account

3.1 Accurate information

Using the service requires creating an account with truthful, complete, and up-to-date information about the Institution and the responsible Administrator. Users must keep this information current for the duration of their relationship with Attendae.

3.2 One account per institution

Each Institution must maintain a single active account on Attendae. Creating multiple accounts for the same Institution to exploit plan features, evade suspensions, or any other unauthorized purpose is not permitted.

3.3 Credential responsibility

The Administrator is responsible for maintaining the confidentiality of their access credentials and all activity occurring on their account. Any unauthorized use must be reported immediately to soporte@attendae.com. Attendae is not liable for damages resulting from failure to meet this obligation.

3.4 Institutional verification

Attendae may require additional documentation to verify the identity and legitimacy of the Institution before activating certificate issuance. Unverified institutions may use the attendance module but will have limited certificate issuance functionality.

4 Conditions of use

This section unambiguously establishes the permitted and prohibited uses of the Platform. Attendae is a tool for real attendance control and issuing proof of actual participation; any use that diverts from this purpose is expressly prohibited.

Permitted uses

  • Attendance control for real, verifiable educational, training, or cultural events.
  • Issuing certificates for attendees who verified their presence through the Platform's check-in mechanisms.
  • Managing participant lists with legitimate institutional registration.
  • Generating and exporting attendance reports for institutional purposes.
  • Publicly verifying the authenticity of issued certificates.

Expressly prohibited uses

  • Certificate forgery: Issuing certificates for participation that did not occur, recording false attendances, or generating documents that do not reflect the beneficiary's actual participation.
  • Institutional impersonation: Registering an account while misrepresenting the Institution as another organization, or using another entity's name, logo, or credentials without express authorization.
  • Personal identity fraud: Registering attendees with third-party data without their consent, or creating fictitious participant profiles.
  • Unauthorized document issuance: Creating fictitious events or bulk-generating certificates without verifiable real participation.
  • Loading personal data without consent: Registering participants in the Platform without them being informed and consenting to data processing.
  • Selling or commercializing certificates: Offering, selling, or exchanging certificates as an independent product without backing from real participation.
  • Automated access or scraping: Accessing the Platform via bots, automated scripts, or mass data extraction tools.
  • Circumventing security controls: Attempting to manipulate or compromise the dynamic QR, geolocation records, the verification portal, or any integrity control.
  • Any use violating applicable law: Including document forgery offenses under the Mexican Federal Penal Code (Arts. 243–247).

Consequences of non-compliance

Violating any of these provisions may result in immediate account suspension without refund, invalidation of fraudulently issued certificates, and reporting to competent authorities when there is reasonable presumption of criminal conduct.

5 Plans and payments

Payments on Attendae are processed securely through Stripe, a payment processor operating under PCI DSS standards. Attendae does not store complete credit or debit card data on its servers.

5.1 Pay-per-event model

Attendae does not operate on a recurring subscription basis. Each event is paid for independently, through two components:

  • Initial service fee: A fixed charge, billed when the event is created, that enables its operation (sessions, participant registration, attendance control). The current amount is published at attendae.com/pricing.
  • Variable charge per certificate issued: An additional charge, calculated in tiers based on the number of certificates in active status at the time the event closes (higher volume, lower unit cost), subject to a maximum cap per event. Prepaid credits on the institutional account are applied first; only the uncovered balance is billed.

5.2 Stored payment method and later automatic charges

By paying the initial service fee for an event, the User expressly authorizes Attendae to retain the payment method used (through Stripe) to carry out, without a new authorization or manual action, the corresponding variable charge once the event closes. This is a necessary condition of the pay-per-event model: the final cost depends on certificates that have not yet been issued at the time the initial fee is paid, so it cannot be charged in advance.

  • When the charge is calculated: The User marks the event as finished from the dashboard; 5 business days after that, Attendae automatically calculates and charges the outstanding variable amount to the card on file.
  • If the automatic charge fails: Attendae will notify the User with a payment link and a 5-calendar-day grace period. If unresolved after that period, Attendae may attempt a backup charge to the same card on file.
  • Consequence of an unresolved balance: While an overdue charge remains unpaid, Attendae may restrict the creation of new events or templates and limit access to exportable participant lists for the affected event, until payment is regularized.
  • Removing the stored payment method: The User may request removal of the stored payment method at any time, provided there are no outstanding charges from already-closed events, by writing to legal@attendae.com.

5.3 Prepaid credits

The Institution may purchase certificate credit packages in advance. Purchased credits do not expire, accumulate in the institutional account, and are non-transferable between different accounts. They are automatically applied before any variable charge at event close.

5.4 Currency and price changes

  • Currency: All prices are in Mexican Pesos (MXN) and exclude VAT (IVA) unless explicitly stated otherwise.
  • Price changes: Attendae may modify the initial service fee, the variable-charge tiers, or credit pricing with at least 15 calendar days' notice, published at attendae.com/pricing. An already-created event keeps the rates in effect at the time it was created; price changes are not retroactive.

6 Refund policy

The full refund policy is in the Refund Policy document, framed under Mexico's Federal Consumer Protection Law (PROFECO). In summary:

  • Full refund: Technical error on Attendae's part that prevented use during the event; duplicate charge; or request within 72 hours of purchase when the event has not yet started.
  • Partial refund (50%): Request between 72 hours and 7 calendar days after purchase, when the event has not yet started.
  • No refund: Event has already started, plan was partially used, or account was suspended for violating these terms.

7 Intellectual property

All intellectual property rights in the Attendae Platform — including without limitation the source code, visual design, trademarks, logos, system architecture, and documentation — are the exclusive property of Cristian Jesus Torres Pacheco and are protected by Mexican and international copyright and industrial property law.

Users retain all rights to content they upload to the Platform (institution logos, participant lists, proprietary documents). By uploading such content, Users grant Attendae a limited, non-exclusive, royalty-free license to use that content solely to the extent necessary to provide the service.

Reproduction, copying, distribution, modification, or reverse engineering of any component of the Platform without prior written authorization is prohibited.

8 Limitation of liability

8.1 User responsibility

The User is solely responsible for the accuracy of content uploaded to the Platform, the legitimacy of events created, and the accuracy of registered participant data. Attendae assumes no liability for how Users employ the service or for the content they generate.

8.2 Service availability

Attendae does not guarantee uninterrupted 24/7 service availability. Planned maintenance will be notified at least 24 hours in advance. Attendae is not liable for damages resulting from service interruptions caused by factors outside its reasonable control, including client-side connectivity failures, third-party service interruptions (hosting, DNS), or force majeure. 8.3 Misuse

Attendae is not liable for direct, indirect, incidental, or consequential damages arising from fraudulent or non-compliant use by Users, nor for decisions made by third parties (employers, academic institutions, authorities) based on certificates issued through the Platform.

8.5 User indemnification

The User (Institution) agrees to indemnify, defend, and hold harmless Attendae (Cristian Jesus Torres Pacheco), its collaborators, providers, and licensors against any claim, demand, penalty, fine, damage, cost, or expense (including reasonable attorney's fees) arising from:

  • Unlawful, fraudulent, or unauthorized origin of personal data loaded into the Platform.
  • Failure to provide a privacy notice or obtain consent from data subjects (including minors).
  • Non-compliance with applicable law by the User or its representatives.
  • Use of the Platform to issue certificates to persons who did not attend the event or did not meet the Institution's requirements.
  • Any act of identity fraud, forgery, or fraudulent use of documents generated through the Platform.

This indemnification obligation survives the termination or cancellation of the service agreement.

9 Modifications

Attendae reserves the right to modify these Terms of Service at any time. Modifications take effect 15 calendar days after publication on this page.

For material modifications affecting User rights, Attendae will notify by email at least 30 days in advance to the registered institutional email address.

Continued use of the service after the notice period implies acceptance of the modified terms. If you disagree with the changes, you may request account cancellation before they take effect.

10 Governing law and jurisdiction

These Terms of Service are governed exclusively by the laws of the United Mexican States, including:

  • Federal Civil Code
  • Federal Consumer Protection Law (PROFECO)
  • Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP)
  • Federal Copyright Law
  • Commercial Code — Arts. 89–94 (electronic contract validity and formation)
  • Federal Penal Code — document forgery Arts. 243–247
  • NOM-151-SCFI-2016 (data message preservation and document digitization)

For resolution of any dispute arising from use of the Platform, the parties agree to submit to the jurisdiction of the competent courts in the city of Morelia, Michoacán de Ocampo, Mexico, expressly waiving any other jurisdiction that may apply based on their current or future domicile.

Attendae operates under current Mexican law. Users domiciled outside Mexico who use the service accept that the contractual relationship is governed entirely by Mexican law and that any dispute will be resolved in the courts of Morelia, Michoacán.
