This Acceptable Use Policy precisely defines the legitimate and prohibited uses of the Attendae Platform. Compliance is an essential and non-negotiable condition for using the service. Attendae implements active controls to detect and prevent fraudulent use, and takes immediate action against any violation, including reporting to competent authorities when warranted.
This policy defines precisely what constitutes legitimate use of the Attendae Platform, distinguishing it from expressly prohibited uses, in order to ensure system integrity, protect participants whose data is processed on the Platform, and comply with applicable law — in particular Mexico's Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP) and the Federal Penal Code.
This policy applies to all Platform Users, including institutional account Administrators, additional users designated by those Administrators, and anyone accessing Attendae's public features.
Attendae is designed and authorized for the following legitimate uses:
The following conduct is strictly prohibited and constitutes a serious violation of this policy, the Terms of Service, and in many cases Mexican criminal law:
Violation of any of these provisions results in immediate account suspension without refund
Issuing certificates for participation that did not occur, recording false attendances, or any action intended to generate documents that do not reflect the beneficiary's actual participation. This includes recording check-ins on behalf of persons not physically present at the event, as well as altering or modifying certificates once issued outside the system.
Creating an account in the name of an educational institution without proper authorization, using an institution's name, crest, or data without its express consent, or misrepresenting one organization as another in order to lend greater legitimacy to issued certificates.
Registering participants in the Platform using real people's data without their knowledge and consent, creating fictitious participant profiles, or performing check-ins on behalf of people who are not present at the event.
Generating participation certificates for beneficiaries who did not effectively attend the registered event, regardless of whether the event was held or not. This includes retroactive issuance for participants with no attendance record.
Importing or registering lists of people in the Platform without those people having been previously informed about the processing of their personal data and having given their consent under the applicable privacy law (Mexico's LFPDPPP or equivalent).
Enabling the geolocation feature for an event without clearly informing participants in advance that their location will be requested during check-in, or without obtaining their explicit consent through the mechanism provided by the Platform.
Offering, selling, exchanging, redeeming, or in any way commercializing certificates as an independent product, without those certificates being backed by the beneficiary's effective participation in a registered and verified event. This includes any "attendance-for-sale," "certificate purchase," or "certificate service" scheme offered to third parties.
Accessing the Platform via bots, automated scripts, mass data extraction (scraping) tools, or any unauthorized method that generates artificial load, extracts data without authorization, or interacts with the system in a non-human manner.
In particular, any conduct constituting document forgery under Arts. 243–247 of Mexico's Federal Penal Code, fraud (Art. 386), ideological falsity, or usurpation of functions or profession (Art. 250 bis) is expressly prohibited.
The conduct described in items 1–4 may constitute criminal offenses under Mexican law, including document forgery (Arts. 243–247 Federal Penal Code), ideological falsity, use of forged documents, fraud (Art. 386), and/or usurpation of functions. Attendae will file a complaint with the appropriate authorities when there is reasonable presumption that any such offense has been committed.
Attendae applies a zero-tolerance policy against fraudulent use of the Platform. Consequences of violating this policy are immediate and may include:
Immediate account suspension — without prior notice when there are clear indications of fraudulent use. Suspension includes blocking access to all Platform features for all users of the institutional account.
Cancellation of credits without refund — credits or plans in the suspended account are permanently cancelled without right to refund, as the violation constitutes a material breach of the service contract.
Invalidation of fraudulent certificates — certificates issued fraudulently are marked as invalid in Attendae's public verification portal, making their non-authentic status publicly visible.
Evidence preservation — Attendae retains all records, logs, IP data, geolocation, and other digital evidence related to fraudulent use, within applicable legal retention periods, for potential submission to authorities.
Reporting to competent authorities — when there is reasonable presumption of a criminal offense (document forgery, fraud, ideological falsity), Attendae will file the corresponding complaint with Mexico's Attorney General or the competent state prosecutor in Morelia, Michoacán, providing all available digital evidence.
Civil action for damages — when fraudulent use causes reputational, economic, or legal harm to Attendae or third parties, the corresponding civil actions under the Federal Civil Code will be pursued.
Permanent access ban — institutions and individuals who have used the Platform fraudulently are permanently barred from creating new accounts on Attendae.
If you are a participant, institution, or any person and detect that Attendae is being used fraudulently — for example, to issue certificates for fictitious events, impersonate institutional identities, or any other prohibited conduct — please report it immediately.
If you detect fraudulent use of Attendae, report it to:
Include any available evidence: institution name, event URL, certificate number or folio, or any other relevant information. We respond within 48 business hours.
Attendae guarantees the confidentiality of abuse reports. Good-faith reporters will not be subject to any adverse action by Attendae.
False or malicious reports may result in suspension of the reporter's account.
This Acceptable Use Policy is governed exclusively by the laws of the United Mexican States, in particular:
Any dispute arising from the interpretation or application of this policy shall be resolved before the competent courts in the city of Morelia, Michoacán de Ocampo, Mexico.
This policy is an integral part of Attendae's Terms of Service. In case of conflict between this policy and the Terms of Service, the Terms of Service shall prevail.
